Terms of Use.

1. Who Provides Sonare

Sonare is operated by Sonare Operations LLC. Sonare intellectual-property materials are held by Sonare IP Systems LLC or used under authorization. References to “Sonare,” “we,” “us,” or “our” in these Terms refer to the applicable Sonare entity providing or owning the relevant product, service, or material.

2. Eligibility

You must be legally capable of agreeing to these Terms. If you are below the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you and supervise your use of Sonare.

3. The Sonare Service

Sonare provides structured audio sessions, selected frequency anchors, listening modes, timing options, and visual environments for lifestyle, mindfulness, relaxation, focus, and entertainment purposes. Features, session availability, access tiers, and device compatibility may change as the product evolves.

4. Limited License

Subject to these Terms and the applicable app-store rules, Sonare grants you a limited, revocable, non-exclusive, non-transferable license to install and use the application and its content for your personal, non-commercial use on supported devices.

You may not copy, redistribute, sell, sublicense, publicly perform, extract, record, reverse engineer, circumvent access controls, create derivative products from, or commercially exploit Sonare sessions, software, visual assets, or other protected materials except where applicable law expressly permits the activity despite this restriction.

5. Acceptable Use

You agree not to interfere with Sonare, attempt unauthorized access, misuse store or entitlement systems, distribute malicious code, misrepresent affiliation with Sonare, or use the product in violation of law or the rights of others.

6. Free Access, Trials, and Subscriptions

Sonare may offer free access, promotional access, free trials, subscriptions, or other in-app purchases. The price, billing period, included features, eligibility requirements, and trial terms shown at the point of purchase control your transaction.

Subscriptions are processed by Apple App Store or Google Play and may renew automatically unless canceled through the applicable store before the renewal date. Deleting the application does not cancel a subscription. You are responsible for managing the subscription through the store account used for purchase.

Trial eligibility may be limited to new or otherwise eligible subscribers. If a trial converts to a paid subscription, the applicable store will charge the payment method associated with your store account unless you cancel before the trial ends.

7. Billing, Cancellation, and Refunds

Apple or Google controls billing, payment processing, taxes, cancellation tools, and refund eligibility for purchases made through its platform. Sonare Operations LLC does not receive or store your complete payment-card number. Refund requests must be submitted to the store that processed the transaction, subject to its rules and applicable law.

8. Intellectual Property

Sonare, its software, session names, audio, visual assets, designs, text, trademarks, logos, and related materials are owned by or licensed to the applicable Sonare entity and are protected by intellectual-property and other laws. No ownership rights are transferred to you.

Feedback may be used to improve Sonare without restriction or compensation, provided we do not publicly identify you as its source without permission.

9. Health and Listening Disclaimer

Sonare is a lifestyle and listening application. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or medical condition. It does not provide medical advice and is not a substitute for professional medical care. Individual experiences vary.

Listen at a comfortable volume. Do not use Sonare while driving, operating machinery, or when reduced awareness of your surroundings could create risk. Stop listening if you experience discomfort.

10. Financial and Market Disclaimer

Sonare does not provide investment advice, market predictions, trading recommendations, trade signals, or guarantees of financial performance. References to traders, markets, pressure, preparation, or decompression describe possible listening contexts only.

11. Privacy

Use of Sonare is also governed by the Sonare Privacy Policy. Platform operators may independently process technical, purchase, security, crash, installation, and compatibility information under their own policies and your store or device settings.

12. Third-Party Platforms

Sonare depends on services provided by Apple, Google, operating systems, app stores, and device manufacturers. Your use of those services is also governed by their terms. Sonare is not responsible for third-party service interruptions, account restrictions, payment decisions, or platform-policy changes.

13. Availability and Changes

We may update, modify, suspend, or discontinue features, sessions, access tiers, or platform support. We do not guarantee uninterrupted or error-free availability. Downloaded assets may require device storage and may need to be downloaded again after an update or device change.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Sonare is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms limits rights that cannot legally be waived.

15. Limitation of Liability

To the fullest extent permitted by applicable law, the Sonare entities and their owners, personnel, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, or loss arising from reliance on Sonare for medical, safety, financial, or professional decisions.

Where liability cannot be excluded, total liability arising from Sonare will not exceed the amount you paid for Sonare during the twelve months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

16. Suspension or Termination

We may suspend or terminate access where reasonably necessary to protect Sonare, users, intellectual property, platform compliance, or legal obligations. Upon termination, the license granted under these Terms ends, but provisions that by their nature should survive will remain in effect.

17. Changes to These Terms

We may update these Terms as Sonare evolves. The effective date will be revised when material changes are published. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.

18. Applicable Law

These Terms are governed by applicable law, without limiting mandatory consumer protections that apply in your place of residence. If any provision is unenforceable, the remaining provisions continue in effect.
